By accessing or using our platform you agree to comply with and be bound by these Terms. Please read them carefully before proceeding.

2. Access to the Platform

Access to our courses and materials is provided on a subscription, enrolment or licence basis. We reserve the right to modify, suspend or withdraw the platform (or any part of it) at any time without notice.

You must keep your user login details and password confidential and notify us in writing immediately if you become aware of any disclosure of your password. Accounts are for individual use only and must not be shared.

3. Use of the Platform

You agree to use the platform solely for lawful purposes and in a manner consistent with these Terms.

You must not use the platform:

  • to upload or share content that infringes the rights of others;

  • to engage in behaviour that is unlawful, defamatory, obscene, or otherwise objectionable; or

  • in any way that may impair the functionality or security of the platform.

4. Copyright & Use of Materials

All course material, videos, slides, audio content, quizzes, downloadable resources and other educational content (the “Materials”) remain the property of Bywater or its licensors and are protected by copyright and other intellectual-property laws.

You are granted a limited, non-exclusive, non-transferable licence to use the Materials for your personal, non-commercial educational purposes only.

You must not:

  • copy, reproduce, distribute, transmit or share any Materials without prior written consent;

  • modify or create derivative works from any Materials;

  • upload or post the Materials elsewhere, including to public forums, websites, or social-media platforms; or

  • use the Materials for the purpose of delivering your own training or courses.

Any live or recorded sessions are subject to the same restrictions. You must not record, screenshot, or redistribute these without our written permission.

We reserve the right to suspend or terminate your access to the platform if we reasonably believe you have breached these terms.

5. Intellectual Property

All trademarks, trade names, logos and branding displayed on the platform are the property of  Bywater or third parties. No licence or right is granted to you to use any of them without express written permission.

6. Payment 

Fees for our courses are displayed at the time of booking or purchase and are payable in accordance with the stated terms.

7. Data Protection and Privacy

Your personal information will be handled in accordance with our Privacy Policy, which forms part of these Terms.

By using the platform, you consent to such processing.

8. Limitation of Liability

To the fullest extent permitted by law, we accept no liability for any indirect, consequential, or incidental loss arising from the use of the platform or the Materials.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

9. Termination

We may terminate or suspend your access immediately, without notice, if you breach these Terms.

On termination, your right to use the platform and any Materials will cease immediately.

10. Changes to These Terms

We may amend these Terms from time to time. Any changes will take effect when posted on our website.

Continued use of the platform following an update constitutes acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may from time to time amend or update this clause; any changes will take effect once posted on our website or platform and your continued use constitutes acceptance of the updated terms.
